Case Study

Focus HR was engaged in 2016 by a local firm to assist with a mental health related WorkCover claim which they had grounds to believe was not a work-related injury. We immediately commenced a formal investigation into the circumstances of the injury, interviewing witnesses and gathering relevant information.
A formal challenge to the WorkCover claim was lodged, addressing each specific situation raised by the employee with evidence that demonstrated that work was not the major contributing factor in causing the injury. WorkCover reviewed all the evidence provided by both the employee and the employer. Their final determination was that they would reject the claim.
This was a great outcome for the employer who was facing the prospect of a lengthy WorkCover case and considerable cost.  As with any successful WorkCover claim, there is also the risk of a common-law claim being initiated, which was negated when the claim was rejected.
